Hilary Duff and ex-boyfriend Joel Madden agreed to a request to drop a temporary restraining order against a photographer whose roommate is accused of stalking the pair, after he convinced them he had nothing to do with the case.

The former couple took out restraining orders against David Joseph Klein and his former roommate Maksim Miakovsky in October 2006.

Klein in no longer living with Miakovsky, who was charged with making criminal threats and stalking Duff last month, and insists he has no involvement with the allegations.

Duff's representative tells E! News, "David Joseph Klein has been dismissed from the cases...based upon his apologies for any misunderstanding, his cooperation and his assurances that he will not seek further contact with Ms Duff and Mr Madden."

Miakovsky remains in jail and has pleaded not guilty to stalking Duff.
